1. ACCEPTANCE OF TERMS

By accessing, booking, or using any Cheater Watchers services, you agree to be legally bound by these Terms and Conditions. If you do not agree with any part, please do not use our services. 

2.WHO WE ARE & WHAT WE DO

2.1 Service Description 

Cheater Watchers provides observational documentation services conducted strictly in public spaces. We observe, document, and report on activities that can be legally viewed by any member of the public. 

2.2 What We Are NOT 

We are: 

• NOT licensed private investigators
• NOT lawyers or legal professionals
• NOT law enforcement
• NOTprovidinglegal advice or private investigation services 

3. STRICTLY PROHIBITED ACTIVITIES

3.1 We Will NEVER: 

• Trespass on private property
• Use GPS tracking or any electronic surveillance
• Record private communications
• Hack or access unauthorized data
• Impersonate others or use false identities
• Engage in any activity requiring private investigator licensure

3.2 You Agree NOT To Request: 

• Any illegal or unethical actions
• Surveillance involving minors without lawful authority
• Activities that violate privacy laws
• Any form of harassment, stalking, or intimidation

4. CLIENT RESPONSIBILITIES

4.1 You Warrant That: 

• You are 18+ years old and legally competent
• All information provided is truthful andaccurate
• You have a lawful purpose for requesting our services
• You will not misuse our deliverables or reports

4.2 You Agree To: 

• Provide clear andaccurateinstructions 
• Not interfere with our operations or investigators
• Use deliverables strictly for personal purposes
• Keep our methods and materials confidential
• Understand that results depend on conditions outside our control

5. PAYMENT & REFUND POLICY

5.1 Payment Terms 

• Full payment isrequiredbefore any service begins 
• Accepted through our approved payment methods
• Clientis responsible forall applicable taxes 

5.2 No-Refund Policy 

All payments are non-refundable. You are paying for our time, effort, and professional discretion, not guaranteed outcomes. Rescheduling may be available with 48+ hours’ notice. 

5.3 Chargebacks 

Unauthorized chargebacks or payment reversals will result in immediate service termination and potential legal recovery of funds plus administrative fees. 

6. SERVICE DELIVERY & DELIVERABLES

6.1 What We Provide 

• Observational documentation within legal public limits
• Written and/or photographic summaries
• Honest, discreet, and lawful reporting

6.2 No Guarantees 

We cannot and do not guarantee: 

• Specific discoveries or results
• Legal admissibility of documentation
• Availability of observable activities
• Exact timelines or outcomes

7. INTELLECTUAL PROPERTY

7.1 Ownership 

Cheater Watchers retains all rights to: 

• Reports, documentation, and collected data
• Operational systems, methods, and templates
• Training and course materials

7.2 Limited License 

You receive a personal-use license only. You may not resell, reproduce, or distribute any deliverables without written permission. 

8. LIMITATION OF LIABILITY

8.1 Liability Cap 

Our maximum liability shall not exceed the total amount you paid for the specific service. 

8.2 No Consequential Damages 

We are not liable for indirect, incidental, or consequential damages including: 

• Emotional distress
• Reputational harm
• Relationship outcomes
• Financial or legal losses

8.3 Time Limit 

Any claims must be filed within one (1) year from the date the issue arises. 

9. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Cheater Watchers, its team, and affiliates from any losses, damages, or claims resulting from: 

• Your breach of these Terms
• Misuse of our services or materials
• Illegal, unethical, or false instructions
• Violation of privacy or third-party rights

10. DISPUTE RESOLUTION

10.1 Mediation First 

Both parties agree to attempt mediation before pursuing legal action. Mediation costs will be shared equally. 

10.2 Governing Law 

These Terms are governed by the laws of Ontario, Canada. Exclusive jurisdiction lies with the courts of Toronto, Ontario. 

10.3 Legal Fees 

The prevailing party in any legal proceeding may recover reasonable legal fees and costs. 

11. GENERAL PROVISIONS

11.1 Entire Agreement 

These Terms, along with all referenced policies, form the complete agreement between the parties. 

11.2 Severability 

If any provision is deemed invalid, the remainder shall remain in full force. 

11.3 Updates 

We may update these Terms at any time. Continued use of our services constitutes acceptance of any changes. 

11.4 Force Majeure 

We are not liable for delays caused by events outside our control — including natural disasters, government restrictions, or technical failures.
